<title>New rules for inbound cargo and mail carried to European Union (EU) airports</title>

<description><![CDATA[<p>Dear Customer,</p>
<p>Herewith we provide you with information concerning relevant security measures that must be met for cargo and mail entering the EU from non-EU countries. This became effective in February 2012.</p>
<p>All air carriers wishing to bring cargo or mail into the Union from a non-EU country must observe requirements&nbsp;laid down in EU Regulation 859/2011 (document available on <a href="http://www.eur-lex.europa.eu/">www.eur-lex.europa.eu</a> ).</p>
<p>As of 1 February 2012, air carriers must ensure that the security controls for all cargo and mail carried for transfer, transit or unloading at an EU airport are at least meeting Standards that are set out in ICAO Annex 17. In addition, air carriers must apply stricter measures for HIGH RISK CARGO AND MAIL (HRCM) which are detailed in EU Commission Implementing Decision C(2011) 5862, a classified document. Appropriate parts of 5862 are only made available to those with a &lsquo;need to know&rsquo;.</p>
<p><span style="text-decoration: underline;">To facilitate handling and movement of your goods at EU airports it is essential that you document the &lsquo;security status&rsquo; of the consignments</span>, either in the form of an air waybill or in a separate declaration and either in electronic format or in writing:</p>
<p>-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &ldquo;SCO&rdquo;, meaning secure for all-cargo and all-mail aircraft only, or</p>
<p>-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &ldquo;SPX&rdquo;, meaning secure for passenger, all-cargo and all-mail aircraft, or</p>
<p>-&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &ldquo;SHR&rdquo;, meaning secure for passenger, all-cargo and all-mail aircraft in accordance with high risk requirements.<br /><br /></p>
<p>All cargo and mail inbound to the EU must hold a security status, including consolidations. For the latter, the lowest level of combined security statuses applies (&ldquo;SHR&rdquo; being the highest and &ldquo;SCO&rdquo; the lowest security status).</p>

<title>Extension of Collective Work Agreement</title>

<description><![CDATA[<p>Cargolux Airlines International S.A and trade unions OGB-L and LCGB today announced that they have formally concluded and signed an extension agreement of the Collective Work Agreement (CWA).<br />The extension of the terms and conditions of the above CWA applies retroactively from 1 January, 2011 and expires on 31 December of the present year. In addition, the parties have signed a second agreement on measures that are required to support and strengthen a comprehensive company-wide action plan after a difficult year 2011 and in the face of challenging conditions in the air cargo markets.<br />It has been agreed to establish a Follow-up Committee that will monitor the situation of the company and meet on a regular basis in order to review and discuss additional measures to be implemented in the event of a further deterioration of the economic environment in 2012.</p>

<title>Cargolux announces appointment of Richard Forson as Chief Financial Officer</title>

<description><![CDATA[<p>Cargolux Airlines International S.A. today announced that the company&rsquo;s Board of Directors approved Richard Forson&rsquo;s appointment as Chief Financial Officer, effective 1 February 2012. Forson, who succeeds former CFO David Arendt, is also a Senior Vice President of the company and a member of the Executive Committee of Cargolux.<br />Forson brings over 20 years of valuable experience in financial, general business and operational management to his role as Cargolux CFO with specific emphasis on the aviation industry. He joins from Wamar International, Inc., a global provider of premium services and products in the fields of power generation, oil &amp; gas, aviation, real life support and defense and security, where he held the position of Senior Vice President and Chief Operating Officer. Prior to that Forson was the General Manager Finance and Administration at Qatar Airways from 2003 to 2006 and before that he spent 13 years at South African Airways, where he held various senior management positions before assuming the role of CFO.<br />He is a South African Chartered Accountant with a Higher Diploma in Tax Law.<br />Speaking of the appointment, Frank Reimen, President and CEO of Cargolux, said: &lsquo;We are pleased to welcome Richard to our executive management team and look forward to drawing upon his extensive knowledge of the financial side of airline operations&rsquo;.</p>

<title>Second time renewal of IOSA certificate</title>

<description><![CDATA[<p>After successfully concluding the required audits, Cargolux Airlines International S.A. has renewed its IOSA (<strong>I</strong>nternational Air Transport Association &ndash; IATA - <strong>O</strong>perational <strong>S</strong>afety <strong>A</strong>udit) certificate for the second time.<br />The IOSA program was initiated in 2003; today, it is an internationally recognized and accepted evaluation system, designed to assess the operational management and safety systems of an airline. The registration is of high importance to Cargolux, not only due to the fact that IOSA registration is a prerequisite to keep IATA membership, but also because it helps the company to take its quality and safety standards to an even higher level. It is also a requirement to operate in a growing number of countries.<br />&lsquo;Our service quality and safety standards keep attracting our customers and therefore we welcome any opportunity for continuous improvement,&rsquo; Cargolux President and CEO Frank Reimen said. &lsquo;Our IOSA registration underlines our strong commitment to the safety of our operations and the safety standards of the airline industry,&rsquo; he added. The renewal audit covered all of the company&rsquo;s operations, including Flight Dispatch, Maintenance, Cabin, Ground Service, Cargo Handling, Quality, Security and Organization, with a key emphasis on safety.<br />The IOSA certificate audit is performed by independent bodies under the supervision of IATA and has to be renewed every two years.</p>

<title>Cargolux confirms guilty plea by two of its executives in US antitrust case</title>

<description><![CDATA[<p>Cargolux Airlines International S.A. today confirmed that Ulrich Ogiermann, Special Advisor to the Company, and Robert Van de Weg, Senior Vice President Sales &amp; Marketing, have entered into a plea agreement with the United States Department of Justice (US DoJ). The agreement includes guilty pleas by both executives and follows their personal indictment by a US grand jury for alleged violations of US antitrust laws. <br />Ogiermann and Van de Weg agreed to sentence serving of 13 months.<br />Cargolux itself pleaded guilty in May 2009 in similar US proceedings against the company and agreed to pay a fine of US$ 119 million. While expressing its regret for the executives personally, Cargolux acknowledges their decision to plead guilty as a way to finally bring this matter to a controlled close both for them and the company. The charges against Ogiermann and Van de Weg relate to conduct they undertook on behalf of the company and do not allege that they derived any personal benefit from the activities in question.<br />To date, a total of 22 airlines and 21 executives have been charged in the DoJ&rsquo;s air cargo investigation and more than US$ 1.8 billion fines have been imposed.<br />Cargolux remains fully committed to abiding by all applicable antitrust laws and regulations at all times and has taken thorough steps across the company to ensure that it conducts its business according to the highest ethical standards.</p>
